OVERVIEW Welcome to Alta Sophia, an Australian clothing brand creating thoughtfully designed clothing for tall women! The terms "we", "us" and "our" refer to Alta Sophia. Alta Sophia operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the "Services"). Alta Sophia is powered by Shopify, which enables us to provide the Services to you. The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services. Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability. By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy [INSERT PRIVACY POLICY LINK]. SECTION 1 - ACCESS AND ACCOUNT To place an order, you must be at least 18 years old or have permission from a parent or legal guardian. To use the Services, including accessing or browsing our online stores or purchasing any of the products or services we offer, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all the information you provide in our stores is correct, current and complete and that you have all rights necessary to provide this information. You are solely responsible for maintaining the security of your account credentials and for all of your account activity. You may not transfer, sell, assign, or license your account to any other person.

SECTION 2 - OUR PRODUCTS Alta Sophia designs clothing for tall women. Available sizes, inseam lengths, fabric details and fit information are shown on each product page. Please check the relevant size guide and product measurements before ordering, as fit can vary between styles. We aim to describe and photograph our products accurately. Colours may appear slightly different depending on your screen settings and lighting. Some images may be labelled as samples, illustrations or digital mockups; any material differences expected in the finished product will be disclosed before purchase. Products must comply with their description and any applicable consumer guarantees. Nothing in these Terms limits those obligations. We may update product listings or discontinue products, but changes will not retrospectively alter an accepted order without your agreement. Products are subject to availability.

SECTION 3 - ORDERS AND PREORDERS When you place an order, you make an offer to purchase the products selected. We accept your order when we send an order confirmation expressly confirming acceptance. Payment must be successfully processed before acceptance. We may decline an order for a reasonable reason, such as unavailable stock, suspected fraud or inability to deliver to the selected destination. If we cannot fulfil an order, we will notify you and refund any payment for the unfulfilled items, including applicable delivery charges. Please check your size, inseam, colour and delivery details carefully. Contact hello@altasophia.com as soon as possible if you need to request a change or cancellation. We may be unable to change an order once it has been dispatched. Your statutory rights remain unaffected. Preorder products are clearly identified on their product pages. Payment terms and estimated dispatch dates will be disclosed before purchase. Estimated dispatch dates refer to when products are expected to leave us, rather than when they will arrive at your address. If a preorder is materially delayed, we will contact affected customers with an updated estimate and offer the option to continue waiting or cancel the affected items for a full refund. If we cannot supply the products, we will refund the affected items and applicable delivery charges. We will seek your agreement before supplying a materially different product. Returns and exchanges are governed by our Refund Policy and applicable consumer law. Our policy does not exclude rights to a repair, replacement, refund or compensation where required by law. Products are intended for personal use. Please contact us before placing an order for commercial resale.

SECTION 4 - PRICES AND BILLING Unless another currency is clearly displayed, prices are in Australian dollars (AUD). Australian consumer prices include GST where applicable and any unavoidable charges that must be included by law. Any applicable shipping charges are disclosed before you confirm your purchase. International orders may attract customs duties, import taxes or local charges. Unless we state that these are included, they are payable by the recipient to the relevant authority or carrier. Prices and promotions may change for future purchases. An accepted order will not be repriced without your agreement. Any additional promotion conditions will be disclosed with the offer. You must provide accurate and current payment, billing and delivery information and be authorised to use the selected payment method. Payment is processed through the payment providers available at checkout.

SECTION 5 - SHIPPING AND DELIVERY Available destinations, shipping charges and estimated delivery timeframes are described in our Shipping Policy and at checkout. Delivery timeframes are estimates unless expressly stated otherwise. Carrier delays, customs processing and other events may affect delivery. We will provide reasonable assistance if your order is delayed, lost or damaged in transit; please contact hello@altasophia.com with your order number. We do not exclude our obligations or your rights under applicable consumer law in relation to delivery. Dispatch to a carrier does not, by itself, remove our responsibility to address delivery problems. Please provide a complete and accurate delivery address. If an address error you make results in additional reasonable redelivery costs, we will explain these costs before arranging redelivery.

SECTION 6 - INTELLECTUAL PROPERTY Our Services, including but not limited to all trademarks, brands, text, displays, images, graphics, product reviews, video, and audio, and the design, selection, and arrangement thereof, are owned by Alta Sophia, its affiliates or licensors and are protected by Australian and applicable international intellectual property laws. These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Services without our prior written consent. Except as expressly provided herein, nothing in these Terms grants or shall be construed as granting a license or other rights to you under any patent, trademark, copyright, or other intellectual property of Alta Sophia, Shopify or any third party. Unauthorized use of the Services may be a violation of applicable intellectual property laws. All rights not expressly granted herein are reserved by Alta Sophia. Alta Sophia's names, logos, product and service names, designs, and slogans are trademarks of Alta Sophia or its affiliates or licensors. You must not use such trademarks without the prior written permission of Alta Sophia. Shopify's name, logo, product and service names, designs and slogans are trademarks of Shopify. All other names, logos, product and service names, designs, and slogans on the Services are the trademarks of their respective owners.

 SECTION 7 - OPTIONAL TOOLS Our website may offer features supplied by third parties, such as payment or shopping tools. Use of these tools may also be subject to the provider’s terms and privacy policy, which should be reviewed before use. We do not control third-party tools. Any exclusion of warranties or liability relating to those tools applies only to the extent permitted by law and does not limit our own obligations or your non-excludable consumer rights.

SECTION 8 - THIRD-PARTY LINKS Our website may contain links to third-party websites. These websites operate independently and have their own terms and privacy policies. A link does not necessarily mean we endorse the website or its content. We do not control third-party websites and are not responsible for their independent conduct, except to the extent required by law. Questions about purchases made directly from a third party should be directed to that seller.

SECTION 9 - RELATIONSHIP WITH SHOPIFY Alta Sophia is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Alta Sophia. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Alta Sophia, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Alta Sophia.

SECTION 10 - PRIVACY POLICY All personal information we collect through the Services is subject to our Privacy Policy, and certain personal information may be subject to Shopify's Privacy Policy at https://www.shopify.com/legal/privacy. By using the Services, you acknowledge that you have read these privacy policies. Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve the Services for you. Information you submit to the Services will be transmitted to and shared with Shopify as well as third parties that may be located in other countries than where you reside, in order to provide services to you. SECTION 11 - REVIEWS AND FEEDBACK You may submit reviews, suggestions or other feedback. You retain ownership of your content and grant Alta Sophia a non-exclusive, royalty-free licence to reproduce and display it for operating and promoting our store, subject to applicable privacy law and any consent required for personal information or identifiable images. Please submit honest feedback, disclose any gifted products or other incentives, and only provide content you have the right to share. Feedback must not infringe another person’s rights, contain unlawful or abusive material, or include malicious software. We may remove content that breaches these requirements. We do not remove reviews simply because they express a negative opinion and will not edit reviews in a way that misrepresents the reviewer’s experience.

SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS We aim to keep our website accurate and may correct errors in product descriptions, prices, availability or delivery estimates. If an error affects your order, we will contact you promptly to explain the issue and any available options. We will not increase the price of an accepted order or materially change the product without your agreement. If an order cannot lawfully or reasonably be fulfilled, we will explain why and refund the affected payment. These provisions remain subject to applicable pricing laws and consumer rights.

SECTION 13 - PROHIBITED USES You may access and use the Services for lawful purposes only. You may not access or use the Services, directly or indirectly: (a) for any unlawful or malicious purpose; (b) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (c) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (d) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or harm any of our employees or any other person; (e) to transmit false or misleading information; (f) to send, knowingly receive, upload, download, use, or re-use any material that does not comply with these Terms; (g) to transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation; (h) to impersonate or attempt to impersonate any other person or entity; or (i) to engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Services, or which, as determined by us, may harm Alta Sophia, Shopify or users of the Services, or expose them to liability. In addition, you agree not to: (a) upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Services; (b) reproduce, duplicate, copy, extract, sell, resell or exploit any portion of the Services; (c) collect or track the personal information of others; (d) spam, phish, pharm, or pretext the services; (e) use any robot, spider, scraping, data gathering and extraction tools, automatic devices or processes, unauthorised automated means to access the Services, except as expressly permitted by Section 14; or (f) interfere with, bypass, or circumvent the security or authorization features, robot exclusion headers, or other measures we employ to restrict access to the Services. We reserve the right to suspend, disable, or terminate your account at any time, without notice, if we determine that you have violated any part of these Terms.

SECTION 14 - AGENTS 14.1 This section ("Agent Terms") applies if you use, allow, enable, or cause the deployment of an Agent to access, use, or interact with any Services. "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, any person or entity and that can be executed on behalf of or using persons device, without direct supervision. 14.2 No Agent may access, use, or interact with Services unless, at all times, it identifies itself and operates in strict accordance with the requirements in section 14.4 below. In addition, no Agent may access, use, or interact with Services if we have requested that the Agent refrain from accessing, using, or interacting with any service. 14.3 We may limit, including by technical measures, whether and how any Agent accesses, uses, and interacts with Services. 14.4 Agents must: (i) in all HTTP/HTTPS requests, identify that the request is from an Agent and disclose the name of the Agent by including the following in the request's user agent string: "Agent/[agent name]"; (ii) not conceal or obfuscate that any access, use, or interactions are from an Agent, such as by (a) mimicking human behavior and interaction patterns, or (b) completing or circumventing CAPTCHAs or measures intended to distinguish computer use from humans, (iii) respond truthfully to any question or prompt seeking to determine if interactions are coming from a human or a computer, (iv) not circumvent or otherwise avoid any measure intended to block, limit, modify, or control whether and how Agents access, use, or interact with the Services.

SECTION 15 - TERMINATION We may restrict or suspend access where reasonably necessary to address fraud, security risks, unlawful conduct or a material breach of these Terms. Where appropriate, we will notify you and provide an opportunity to resolve the issue. Termination does not remove rights relating to existing purchases, outstanding refunds or other rights and obligations that have already arisen. Provisions that by their nature should continue, including intellectual property and applicable dispute provisions, survive termination.

SECTION 16 - CONSUMER GUARANTEES AND WEBSITE AVAILABILITY Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. Nothing in these Terms or our policies excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded, restricted or modified. This applies throughout these Terms, including the provisions concerning Shopify, third-party services, shipping and liability. We take reasonable care in operating the website but cannot guarantee uninterrupted or error-free access. General website information does not replace the product descriptions or commitments applicable to your purchase.

SECTION 17 - LIABILITY Alta Sophia remains responsible for its obligations under applicable law, including consumer guarantees and any remedies or compensation required by law. To the extent permitted by law, we are not responsible for losses caused by your misuse of the website, unauthorised changes you make to products, or independent third-party conduct for which we have no legal responsibility. Nothing in these Terms excludes liability for fraud, negligence or any other liability where exclusion would be unlawful. You are not required to waive non-excludable rights as a condition of purchasing from us.

SECTION 18 - RESPONSIBILITY FOR MISUSE You are responsible for your unlawful use of the Services and for content you submit in breach of these Terms. Any claim concerning that conduct will be determined under applicable law. These Terms do not require you to indemnify us for losses caused by our own conduct or impose a general obligation to pay our legal costs.

SECTION 19 - SEVERABILITY In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

 SECTION 20 - WAIVER AND ENTIRE AGREEMENT A failure or delay by either party to exercise a right does not waive that right. These Terms, the policies referenced in them and the details agreed for your order form the agreement governing your use of the Services and purchases from Alta Sophia. They do not exclude legally binding representations, consumer guarantees or other rights that cannot be excluded by law.

 SECTION 21 - ASSIGNMENT Neither party may transfer obligations under these Terms in a way that materially reduces the other party’s rights without that party’s consent, except where permitted by law. Any lawful transfer by Alta Sophia will preserve your existing purchase and consumer rights. SECTION 22 - GOVERNING LAW These Terms are governed by the laws of Victoria, Australia. Subject to any mandatory rights to bring a claim elsewhere, you and Alta Sophia submit to the non-exclusive jurisdiction of the courts of Victoria. If you live outside Australia, nothing in these Terms removes any mandatory consumer protections that apply to your purchase under the laws of your country.

SECTION 23 - HEADINGS The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

SECTION 24 - CHANGES TO THESE TERMS We may update these Terms for future use of the Services. The current version will be available on this page with its effective date. We will give notice of material changes where required by law. Changes will not retrospectively alter accepted orders or accrued rights without your agreement. The terms in effect when your order was accepted apply to that order.
